Please read these Terms of Use ("Terms") carefully before using the Dailybird mobile application (the "App") operated by INSCODE IT Consulting ("we", "us", "our").

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

Dailybird is a mobile application that allows you to create and track countdown and count-up events. The App stores data locally on your device and provides features including event creation, photo customization, reminders, and notes.

3. User Content

You retain all rights to the content you create within the App, including event names, notes, and photos you select. You are solely responsible for the content you add to the App.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Attempt to gain unauthorized access to the App's systems or networks
• Use the App in a way that could damage, disable, or impair its functionality

5. Intellectual Property

The App, including its design, code, graphics, logo, and other content, is the property of INSCODE IT Consulting and is protected by copyright and other intellectual property laws. The Dailybird name and bird logo are trademarks of INSCODE IT Consulting.

6. Third-Party Services

The App integrates with third-party services including:

• Unsplash: For free stock photos. Use of Unsplash images is subject to the Unsplash Terms.
• Firebase & Amplitude: For anonymous analytics. See our Privacy Policy for details.

We are not responsible for the practices or content of third-party services.

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The App will be uninterrupted or error-free
• Defects will be corrected in a timely manner
• The App will meet your specific requirements

8. Limitation of Liability

To the fullest extent permitted by applicable law, INSCODE IT Consulting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, arising out of or in connection with your use of the App.

Since the App stores data locally on your device, we are not responsible for data loss due to device malfunction, uninstallation, or other causes outside our control.

9. Indemnification

You agree to indemnify and hold harmless INSCODE IT Consulting from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

10. Modifications to the App

We reserve the right to modify, suspend, or discontinue the App at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of changes by posting the new Terms on this page and updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law provisions.
